Punishments and Charges

The charges associated with a controlled substance or drug are closely related to how that drug is classified. In Maryland, marijuana is classified as a “Schedule I” substance, the category associated with some of the most severe penalties. Other factors which can influence the penalties for a marijuana crime include where the alleged offense took
place, if a minor was involved, and a defendant’s past criminal conduct.

Depending on the nature of the offense, marijuana crimes can be charged as either a misdemeanor or felony. For example, the first offense for possession (among the most common drug-related charges) of 10g of marijuana is a misdemeanor punishable by up to a year in jail and $1,000 in fines. If the defendant is instead accused of intent to distribute, they could be facing felony charges punishable by 5 years in prison and $15,000 in fines. The seriousness of these crimes cannot be emphasized enough and if you have questions about your case, do not hesitate to contact my firm.
